Tenants, on the other hand, have the right to terminate their rental agreement at the end of the term or even earlier. IN DUBAI, WHEN CAN I CANCEL EJARI?

In Dubai, Ejari safeguards the rights of both tenants and landlords.

It is possible to terminate your Ejari contracts, whether you are a renter or a landlord. There are two options for doing so:

  • Early rental contract termination
  • If the parties do not choose to extend the contract at the conclusion of the lease, the contract is cancelled.

Your Ejari contract will not be automatically terminated when it expires. As a result, relocating to another location/property (if you are a renter) or leasing out your property to a new party will be challenging (as a landlord).

According to RERA law, a property should only have one Ejari registration. That is why it is the landlord’s obligation to cancel the Ejari as soon as the renter goes out.

EJARI CANCELLATION PROCEDURE: HOW TO CANCEL EJARI

DOCUMENTS NEEDED FOR EJARI CANCELLATION VIA REAL ESTATE TRUSTEES CENTRE

You will need the following to cancel Ejari:

  • Both parties’ Emirates IDs are required.
  • Certificate from Ejari
  • The passport of the tenant
  • The landlord’s No Objection Certificate (NOC)
  • The tenant’s most recent DEWA bill
  • The first consolidated tenancy contract
  • A letter of termination from the property owner

If the renter is a corporation, you must present both the owner’s and manager’s Emirates ID and trade license.

You must also send a copy of your Ejari certificate. If the Ejari certificate is not accessible, the tenancy contract can be used in its place.

The following information should be included in the Ejari cancellation NOC letter:

  • The landlord’s name
  • Title of the structure
  • DEWA premise code
  • The plot number
  • Tenant’s personal details
  • A vacancy announcement
  • The landlord’s signature is required (matching the signature on his passport)
  • The corporate logo (if the landlord is a company)

Please keep in mind

  • The submission of the final DEWA bill is the most essential stage in the Ejari cancellation procedure. If there are any outstanding DEWA invoices, the cancellation procedure is still incomplete.
  • If you send a physical copy of the bill, the words ‘Final Bill’ and ‘Paid’ should be clearly stamped. You can also submit a copy of the “Green Bill,” which is available for download on the DEWA website.

EJARI CANCELLATION SUPPLEMENTARY DOCUMENTS

Moving forward, further documents may be required in exceptional circumstances. For example, if the property was sold during the tenancy period and the buyer took over the lease, you must provide the title document. If the new owner is not a UAE resident, they must additionally produce a copy of their Emirates ID or a valid passport.

Similarly, if a landlord’s representative signed the tenancy agreement, they must also produce the Power of Attorney authorizing the representative to sign the lease on the owner’s behalf. In addition, the representative must provide their Emirates ID, residence visa, or passport.

ONLINE CANCELLATION OF EJARI

There are several options for canceling Ejari online. You can choose from the following options.

TRUSTEES CENTRES FOR REAL ESTATE SERVICES

  • Visit the Real Estate Services Trustee Centres (also known as Ejari Cancellation Centres).
  • Submit the necessary documentation.
  • Wait for the transaction data to be verified and approved.
  • Pay the charge and obtain a receipt.

BY WAY OF THE DUBAI REST APP

  • Register for or log in to the Dubai REST app.
  • Please include all necessary information.
  • Please provide all essential documentation.
  • Submit the application
  • Wait for the review. If your request is granted, you will receive an email.

ACCESSED VIA DLD'S WEBSITE

  • Visit the website of the Dubai Land Department (DLD).
  • Choose the “Services” tab.
  • From the drop-down option, select “Tenant.”
  • Select “Real Estate Rental Services” from the drop-down menu.
  • Continue to “Ejari Contract Cancellation Request.”
  • On the upper left, click “Access this Service” (the “green” tab).
  • Log in as an owner/tenant/individual/business user to your DLD account.
    • Enter your Emirates ID or your user name/password (Business users)
    • Enter your Emirates ID, cellphone number, title deed, or email address (for owners, tenants, or people).

You can also do the following:

Login with UAE Pass

  • To login, enter your cellphone number/Emirates ID/email address.
    • Continue with the procedure completion.

HOW MUCH DOES CANCELLING EJARI COST?

The cancellation charge for Ejari varies based on the method you pick. It is completely free to apply using the app. It will, however, cost you AED 40 to cancel it through Real Estate Services Trustees Centres (excluding VAT).
